Terms and Conditions

INGREDIENTS

All cakes, fillings, icing, figures may contain, or come in contact with nuts, soy, milk, wheat or other allergens.

It is the responsibility of the customer to inform Kim’s Kitchen Magic prior to confirmation of their booking, of any allergies/intolerance issues. It is the responsibility of the customer to also inform their guests of all allergy/intolerance information, and accordingly the supplier, Kim’s Kitchen Magic will not be held liable for any allergic reaction resulting from the consumption of the cake, filling, icing or figure.

All products are made to be eaten on the original scheduled day of the celebration/event.

QUOTES

All quotes are valid for 30 days from the date of issue.

All quotes are not bookings and are subject to availability.

In the event that the wanted date is no longer available as it has been filled by another order prior to the customer confirming the booking Kim’s Kitchen Magic is not obliged to honour the quote.

ORDERS

Kim’s Kitchen Magic would prefer at least 21 days notice for all orders to ensure we are able to take your booking.  I will however always do my best to accommodate your subject to availability.

All cakes/products that are ordered with a supplied photograph or drawing of another cake makers product need to understand that due to copywrite laws Kim’s Kitchen Magic can only reproduce my interpretation of the product and it WILLNOT be an exact copy of the photograph or drawing. To do so would be against the law.

DEPOSITS

A non-refundable retainer of 50% of the order cost is to be paid to hold your date, seven (7) days from the date of the invoice issued, if the pick up date is in excess of one (1) month.

All deposits are to be paid by bank transfer details are on the invoice.

If Kim’s Kitchen Magic has delivered on a product that is an accurate interpretation of what has been quoted and invoiced, but the customer does not accept the final product, the retainer will NOT be refunded. The customer can choose to pay any outstanding balance of payment  and take the product or leave the product with Kim’s Kitchen Magic at no extra cost.

OTHER DEPOSIT CONSIDERATIONS

Any order placed within Fourteen (14) days of pickup requires the 50% non-refundable retainer to be paid within 48 hours of the invoice being issued. Balance due prior or at cake pickup.

Any order placed within seven (7) days of pickup requires 100%/the FULL amount to be paid within 24 hours of the invoice being issued.

UNFORSEEN CIRCUMSTANCES

Where Kim’s Kitchen Magic cancels a booking due to illness or any other unforeseen circumstance that affects the ability to deliver on an ordered product, the retainer will be refunded within seven (7) days of notification of cancellation to the customer. The retainer will be refunded to the customer via bank transfer only and the customer will need to provide those details to Kim’s Kitchen Magic for this to occur.

FINAL BALANCE AND PICK UP OF PRODUCT

The balance is due on or prior to the pickup date and before any product leaves the premises of Kim’s Kitchen Magic.

If paying by cash, correct money is appreciated as no cash is kept on the premises. Change will not and cannot be provided by Kim’s Kitchen Magic. If you are paying via bank transfer, the money will need to clear before the product (cake) can leave the premises.

DELIVERY

Kim’s Kitchen Magic does not offer delivery at this time for any product other than wedding orders. Pickup will be a date and time agreed upon by both parties prior to pickup. If the customer is not on time for pickup it is NOT Kim’s Kitchen Magic’s responsibility to contact the customer and arrange another day/time, then it is the customers responsibility to collect the product at a time that suits Kim’s Kitchen Magic.

Wedding order deliveries are to be carried out in a safe and appropriate manner. Once delivered to the customer and change of hands has been completed with the product in the appropriate condition. It is then up to the customer to store and care for the cake as per Kim’s Kitchen Magic instructions. If anything is to happen to the cake after this exchange, and deemed (by Kim’s Kitchen Magic) to be the fault of the customer  through not following the instructions provided, Kim’s Kitchen Magic is NOT liable for any damages. As above a delivery date, time and place will be arranged and agreed upon by both parties. If the customer is not at this location at the time and date organised and Kim’s Kitchen Magic is not able to contact the customer in a timely fashion, the product will be transported back to Kim’s Kitchen Magic and it will be the customers responsibility to collect the product at a time that suits Kim’s Kitchen Magic.

PUBLICATION

Kim’s Kitchen Magic reserves the right to use any image of a product made by us for publication at a later date. Kim’s Kitchen Magic will endeavour not to post any photographs on social media or other platforms until after your scheduled event has taken place.

Kim’s Kitchen Magic will however not publish any photograph of the finished product at a private event eg: children’s birthday party, engagement party, without obtaining the customers consent first.

GIFT VOUCHERS/ PRIZES WON

Any gift vouchers or prizes being redeemed will only be honoured if the pick up date is within the expiry period of the voucher or prize.

Voucher or Prize must be presented upon picking up of product, otherwise the item cannot and will not leave the premises. The voucher/prize must be surrendered upon pickup as is to be treated like cash. Voucher or Prize CANNOT be exchanged for cash.

LIMIT OF LIABILITY

All complaints must be notified to Kim’s Kitchen Magic in writing or via phone call, within 24 hours from the date and time of collection/delivery (or proposed event date), and the product MUST be returned personally by the customer to Kim’s Kitchen Magic for inspection.

If there is a problem with the product (taste, texture), I do need to have this returned to me so I can confirm for myself. If there is a problem with the cake visually, photographs are sufficient if it shows the flaws clearly. Seeing these flaws will enable me to know exactly what has happened with the cake.

Kim’s Kitchen Magic values my customer satisfaction and will endeavour to reach a mutually acceptable solution if possible.

DAMAGE

It is the responsibility of the customer/or the person collecting the cake on your behalf to check the state of the product before leaving the premises. Once a product has left the premises, the customer accepts the item as is, and is responsible to ensure the product gets to it’s destination safely and that the product is stored as per instructions from Kim’s Kitchen Magic to achieve the best results for taste, quality, finish and to avoid any damage.

CANCELLATIONS/REFUNDS

If cancellation of the order is required and you have paid your full balance the refund policy is as follows:

If the cancellation is up to one (1) month in advance of your event date you will receive a refund, less your initial retainer and the cost of any supplies already purchased for your product.

If the cancellation is less than seven (7) days prior to your event, there will be absolutely no refunds given.

Refunds will be paid within 30 days of cancellation.

The monies, if owed, will be refunded via bank transfer only and the customer is responsible for providing their bank details to Kim’s Kitchen Magic for this to happen.

Please Note: Any non-refunded balance may be credited towards a future purchase, at the discression of Kim’s Kitchen Magic.
